Terms of Service

This page explains the terms that apply to the Bondings mobile application, connected Bondings smart photo frame products, websites, and related services operated by AZORES LABS, INC.

These Terms of Service ("Terms") are a legal agreement between you and AZORES LABS, INC. ("AZORES LABS," "we," "us," or "our"). By accessing or using the Bondings mobile application, connected Bondings smart photo frame products, websites, AI features, account services, payment features, support channels, or related services (collectively, the "Service"), you agree to these Terms.

1. The Service

Bondings lets users register accounts, pair and manage connected smart photo frames, upload or select photos, manage display playlists, use supported AI image and voice prompt features, and use related account, support, and payment functionality. Some features may be available only in specific countries, languages, platforms, app versions, or device models.

2. Eligibility

You must be legally able to enter into these Terms. The Service is intended for adults who manage a connected household photo frame and is not directed to children under 13. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Account Registration and Security

You are responsible for providing accurate account information and for keeping your login credentials secure. You must promptly notify us if you believe your account has been compromised. We may refuse, suspend, or terminate accounts that violate these Terms, create security risk, or are used for fraud, abuse, or unlawful activity.

4. Bondings Devices and Setup

You are responsible for your Bondings smart photo frame, network connection, Wi-Fi credentials, and the content you choose to display. During setup, the Service may use Bluetooth, Wi-Fi scan results, camera access, and other local device capabilities to discover, bind, configure, and maintain a paired Bondings frame. You must have permission to configure any network or device that you connect to the Service.

5. User Content

"User Content" includes photos, images, AI prompts, generated images, voice prompts, transcriptions, playlist settings, device names, support messages, and any other content you submit or create through the Service. You keep ownership of your User Content, subject to the rights you grant us below.

You grant AZORES LABS a worldwide, non-exclusive, limited license to host, store, copy, transmit, display, process, convert, resize, synchronize, and otherwise use your User Content only as reasonably necessary to operate, secure, and support the Service and provide the user-facing features you request.

You are responsible for ensuring that you have the rights and permissions needed to upload, generate, share, or display User Content. You must not upload or generate content that is unlawful, infringing, abusive, exploitative, deceptive, or otherwise violates these Terms or applicable law.

6. AI and Voice Features

The Service may include AI image-generation, prompt assistance, voice transcription, or similar features. AI outputs may be inaccurate, unexpected, or similar to content generated for other users. You are responsible for reviewing AI outputs before using or sharing them. We do not use your photos, voice recordings, Google user data, or AI prompts for targeted advertising. We do not use such content to train our own or a third party's general-purpose AI models unless we first provide a separate, clear disclosure and obtain any consent required by law.

7. Payments and Subscriptions

If paid features, subscriptions, or purchases are offered, payment processing may be handled by Stripe, app stores, or other payment providers. We do not receive or store your full payment card number. App store purchases may also be subject to the applicable Apple App Store, Google Play, or other platform terms and refund rules.

8. Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes attempting to gain unauthorized access, bypassing security controls, disrupting the Service, reverse engineering except where legally permitted, using the Service for unlawful surveillance or harassment, uploading malware, infringing intellectual property rights, exploiting or harming children, or using the Service in a way that violates applicable law or third-party rights.

9. Third-Party Services

The Service may interoperate with third-party services such as Google Sign-In, Google Photos, Google Cloud, Stripe, Gemini, ChatGPT, or other infrastructure, AI, payment, or support providers. Your use of third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services that we do not control.

10. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Service, you acknowledge the practices described in the Privacy Policy. Where consent is required by law or platform policy, we will request it separately before collecting or accessing the relevant data.

11. Changes to the Service

We may modify, suspend, or discontinue all or part of the Service, including features, device integrations, storage limits, AI functionality, or subscription options. We will provide notice where required by law or where changes materially affect your rights or obligations.

12. Termination

You may stop using the Service at any time and may request account deletion as described below. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for the Service or other users, or used the Service unlawfully. After termination, sections that by their nature should survive will continue to apply, including ownership, privacy, disclaimers, liability limits, and dispute terms.

13. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, and error-free operation. Some jurisdictions do not allow certain disclaimers, so some of these limitations may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, AZORES LABS and its officers, directors, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to the Service or these Terms. Our total liability for any claim will not exceed the amount you paid to us for the Service in the 12 months before the claim arose, or USD 100, whichever is greater.

15. Indemnity

You agree to defend, indemnify, and hold harmless AZORES LABS from claims, damages, liabilities, costs, and expenses arising from your User Content, your misuse of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.

16. Governing Law

These Terms are governed by the laws of the State of California, United States, excluding conflict-of-law rules, unless mandatory consumer protection laws in your place of residence require otherwise.
